Terms and conditions of use
These General Conditions of Online Sales regulate the contract for the sale of products offered by Cuor di Sardegna through its website www.cuordisardegna.com to users of the site.
PRICES
All prices displayed on products include VAT applicable in compliance with laws in force.
To the prices shown on the site, for each of the products, must be added their shipment and delivery costs, which will be duly shown and summarized before the order is issued and subsequently also on the order confirmation.
For any pack of ravioli, culurgiones and seadas, Additional € 1.00 will be charged as delivery charge.
DELIVERY OF PRODUCTS TO CUSTOMER
When the products are delivered to the customer by the courier, the customer must check: a) that the quantity and type of ordered products corresponds to whatever indicated on the transport document; b) that the packaging used for transport is integral, not damaged, wet or altered in any way, including as regards the sole wrapping material.
Any faults must be immediately disputed with the courier upon receipt of the products, and indicated on the delivery note. In order to facilitate and speed up any fault checking procedure by Cuor di Sardegna, the customer can send an email message to the address cuordisardegna@libero.it.
We recommend that you always check the number and the integrity of packages. In case of malfunctions or damages, the complaint must be made immediately to the courier. The cost of replacement and return will be entirely on us.
Cuor di Sardegna disclaims any responsibility for the acceptance of a damaged parcel not occurred at the time of delivery in the presence of the carrier.
To avoid stocks, which could damage the product (unless otherwise provided by the customer to be indicated by email) food will only be shipped on Mondays and Tuesdays.
We remain at your disposal for special requirements concerning the time of shipment or delivery, or for any special request.
For a better and efficent service would be good to include your phone number.
The shipment will be at all times kept in check by the customer through traceability code of the package (sent by email).
No shipments to the Spanish islands.

AVAILABILITY
Information on the availability of products offered can be found on the website and in the presentation page for each product.
Product sending and delivery times are indicative. They cannot be considered as fully reliable as they do not depend on the company’s will and activity as it avails itself of third parties. Once we have received your order, we will inform you by email if any of the products ordered by you are not available.
RIGHT OF WITHDRAWAL (D.Lgs. 06/09/05 N°206)
Pursuant to art. 64 et seq. of Legislative Decree no. 206/2005, if the Customer is a consumer (individual acting for purposes that are unrelated to their business) he/she is entitled to withdraw from the purchase agreement for whatever reason, without incurring in any penalty and provided only that the following rules are respected, within ten business days from receiving the goods.
The right of withdrawal may be exercised by sending, in the terms indicated above (14 days), a written notice to the registered address of :

by registered letter with return receipt requested, copy sent in advance by e-mail. The registered letter will be deemed to have been sent in due time if posted in the terms indicated above and certified by the post office stamp.
Pursuant to the Italian legislation you can return your product within 14 working days from the delivery date of the last product of your order.
Once the Online Withdrawal Declaration has been received, Cuor di Sardegna will promptly give the customer instructions for return, assigning a specific AMR (Authorized Merchandise Return) that the customer is asked to use when returning the Product.
The Product must be returned to Cuor di Sardegna within 14 working days of the date of communication of the AMR number.
Products must be returned in accordance with terms specified in our Terms & Conditions of Sales: Read all details on the Right of Withdrawal.
"Returns" are subject to the following conditions:
In order for returns/exchanges to be accepted, the right of return should be applied to product purchased in its entirety; it cannot be exercised in relation to single parts and / or product accessories.
The complete integrity of the item is an essential condition for exercising the right of withdrawal. The product should be kept with normal conscientiousness and returned intact, complete in all its parts, with no signs of wear or dirt, it should not have been used, worn, washed or damaged.
The right of withdrawal does not apply in relation to products made according to the customer's specifications or clearly tailored to the customer's request or which by their specific nature, cannot be returned or are liable to deteriorate or expire rapidly.
Products must be returned in their original packaging (bags and/or packaging), complete with all their parts (including the identification tag, which must still be attached to products with the disposable seal, that is an integral part of the product).
In order to limit damages to the original package, we recommend inserting it in a second box, affixing the label provided by us, with the RMA Number (Return Merchandise Authorization). In all cases it should be avoided affixing labels or tape directly on the original product packaging.
The expedition, until the arrival in our warehouse is under the full responsibility the customer.
Refund terms
If a Customer exercises his/her right of withdrawal hereunder, Cuor di Sardegna will refund the amounts paid by the Customer, except for the shipping costs incurred to deliver the product. All costs of returning the product to the sender shall be payable by the Customer.
The money will be refunded by bank transfer, so the Buyer shall promptly provide their bank details (IBAN).
APPLICABLE LAW AND PLACE OF JURISDICTION
The GCS are regulated by Italian law and in particular by the code and by the legislative decree no. 70 dated 9 April 2003 relating to particular e-commerce aspects.
For any disputes arising relating to the validity, construal, execution and cancellation of these GCS and/or individual purchase orders, the only competent law court, without competition, shall be that of Nuoro (Italy) with express and total reciprocal waiver of any other law court.
